Terms Of Services

1. User Obligations
a) The user agrees not to use the Dig Info Tec Platform in any manner that violates laws or regulations, potentially leads to fraud, or subjects Dig Info Tec or its Platform to investigation or legal action.

b) Users may only utilize Bank Account/Card information provided to Dig Info Tec by the Merchant’s software for completing transactions, and may not sell or share this information unless independently obtained.

c) Users must comply with the terms and conditions set by Dig Info Tec and are prohibited from modifying, translating, disassembling, decompiling, or reverse-engineering the Platform without prior written consent from Dig Info Tec.

d) Users must adhere to Dig Info Tec’s “know your customer” (KYC) requirements and provide accurate information.

2. Merchant Obligations
a) Merchants must comply with applicable laws, rules, and regulations relevant to their use of the Dig Info Tec Platform.

b) Merchants must not process or deposit transactions for any other merchant establishment.

c) Merchants cannot accept payments from customers to refinance existing debts.

d) Merchants must ensure data extraction from the Payment Instrument is conducted as specified by Dig Info Tec.

e) Merchants must provide customers with a digital or paper receipt indicating the transaction amount.

f) Merchants cannot require customers to pay any surcharges, discounts, or finance charges related to transactions involving a Payment Instrument.

g) Merchants grant Dig Info Tec a non-exclusive, royalty-free license to use their trademarks and logos for marketing the Payment Aggregation Service.

h) Merchants authorize Dig Info Tec to include their name in promotional materials related to the acceptance of Dig Info Tec.

i) Merchants must implement prescribed security measures on their website or mobile application for accepting payments.

j) Merchants must comply with all written instructions from Dig Info Tec regarding payments from electronic transactions.

k) In case of disputes, chargebacks, or fraudulent activities, the Acquirer/Platform Provider reserves the right to refund the accountholder/cardholder using the merchant’s available funds. If funds are unavailable, the Acquirer/Platform Provider may recover them from the merchant through legal means.

l) Merchants must provide accurate information during ownership verification. Falsifying information may result in penalties and account suspension.

3. Transaction & Settlement
a) Dig Info Tec will ensure merchants receive settlements within the agreed timeframe unless unforeseen circumstances arise, in which case merchants will be informed of the delay.

b) The transaction information must pertain to genuine transactions compliant with this agreement.

c) Merchants must retain records related to E-Transactions for at least five (5) years from the authorization date.

4. General Obligations
a) Merchants must adhere to all general rules and service provider policies outlined in this agreement.

b) Merchants must comply with applicable laws, including those governing the sale of products and services related to electronic transactions.

c) Merchants are responsible for fulfilling obligations related to the sale of products and services to customers.

5. Accepting Payments from Buyers for Goods & Services
a) Merchants may only accept payments and process reversals related to products or services sold directly to customers.

b) Payments and reversals must pertain only to products or services within the merchant’s identified business scope.

c) Merchants must notify Dig Info Tec in writing before making any changes to their product or service offerings.

d) Merchants must provide Dig Info Tec with the URL of any website accepting payments through digital banking channels before processing such payments.

e) Merchants must accept payments and submit data to Dig Info Tec for transactions authorized by customers according to applicable laws and this agreement.

f) Merchants must avoid actions that could damage Dig Info Tec’s reputation.

g) Merchants indemnify Dig Info Tec and its representatives from obligations towards their customers that may lead to claims or actions against Dig Info Tec.

6. Disputes
a) In case of disputes between the merchant and a customer, Dig Info Tec will not be involved in any litigation and will be indemnified against any consequences.

b) Merchants cannot refuse returns or cancellations of services based on the payment method used.

7. Refunds & Chargebacks
a) For returned goods or cancelled services, merchants must electronically refund the accountholder/cardholder the net amount after applicable charges.

b) Merchants must retain relevant correspondence regarding E-Transactions for at least five (5) years.

c) The Acquirer/Platform Provider can withhold payments to merchants in various circumstances, including failure to obtain proper authorization, breach of the agreement, or failure to provide requested transaction information.

d) In cases of disputes or fraudulent activity, the Acquirer/Platform Provider may refund the accountholder/cardholder using the merchant’s funds.

e) Merchants will incur a service charge equivalent to the percentage of the original transaction for each chargeback incurred. This will be deducted from their settlement or paid directly to Dig Info Tec.

f) Dig Info Tec is not liable for refunds related to chargebacks, including subscription, setup, integration, or security deposits.

8. Indemnity
a) Merchants indemnify Dig Info Tec and its representatives from obligations towards their customers that may lead to claims or economic loss.

b) Merchants understand that Dig Info Tec merely provides an online payment solution, and any breach of obligations may render Dig Info Tec liable to its service providers.

9. Prohibited & Banned Items
Merchants guarantee that the following products and services will not be offered or sold:
i. Firearms
ii. Alcohol
iii. Explosives
iv. Pornography or related materials
v. Live animals
vi. Illegal drugs or controlled substances
vii. Fireworks or pyrotechnic devices
viii. Hazardous materials
ix. Bulk email software or mailing lists
x. Gambling transactions
xi. Multi-level marketing fees
xii. Matrix schemes
xiii. Promotions for work-from-home opportunities
xiv. Website promotion fees
xv. Wire transfer products and services
xvi. Any goods or services that violate applicable laws in Pakistan

10. Confidentiality & Security
a) Merchants must ensure the confidentiality of all user/customer information submitted on their website or mobile application and implement appropriate encryption and security measures. Any losses due to hacking or data breaches will be the merchant’s responsibility.

b) Merchants must take all necessary precautions to maintain the integrity of the link between their platform and Dig Info Tec’s Internet Payment Gateway. Any losses resulting from compromised links will not be the responsibility of Dig Info Tec, and merchants will hold Dig Info Tec harmless from related claims.

11. Dig Info Tec’s Copyright and Trademarks
“diginfotec.com,” “Dig Info Tec,” and all related logos are trademarks or registered trademarks. Users may not copy, modify, or use them without prior written consent. All content and technology on Dig Info Tec’s websites are the exclusive property of Dig Info Tec and its licensors.

12. Other Businesses
Services or products may be offered by parties other than Dig Info Tec on its site. If you purchase from these third parties, you are doing so directly with them, not Dig Info Tec, which is not responsible for their actions or content.

13. Disclaimer
The website’s content and functionality are provided on the understanding that Dig Info Tec is an intermediary between banks, Payment Service Organizations, and merchants. All services are provided “as is” without warranty of any kind. Users acknowledge that using the website and services is at their own risk. Dig Info Tec is not liable for any damages resulting from the use or inability to use the website or services.

14. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of Pakistan. Any disputes not amicably resolved shall be referred to the competent courts in Pakistan, whose decisions shall be final and binding on all parties.
